1. Introduction

Welcome to the Cox Property Repair website (the “Site”). These Terms & Conditions (“Terms”) govern your use of our Site and services. By accessing or using the Site, you agree to comply with and be bound by these Terms. If you do not agree with these Terms, please do not use our Site or services.

2. Services Offered

Cox Property Repair provides general handyman services for all aspects of a home or commercial building. Our services are delivered by our employees and/or licensed subcontracted vendors.

3. Payment Terms

All payments are due upon the completion of services. We accept payments via credit and debit cards. Please ensure that your payment method is valid and that you have sufficient funds to complete the transaction.

• Late Payments: Late payments may incur a penalty of up to 10% of the outstanding balance per month, as allowed by Kansas law. While there is no legal requirement for a grace period, we may allow a grace period of up to seven days as a courtesy.
• Payment Disputes: If you have any disputes regarding payments, please contact us immediately to resolve the issue.

4. Refund Policy

We aim to provide the highest quality service. If you are not satisfied with our services, please contact us within 30 days of service completion. Refunds will be considered on a case-by-case basis and may be issued at our discretion. If a refund is approved, it will be processed to the original payment method within a reasonable timeframe. Refunds will not be provided for issues resulting from misuse of services or failure to report issues within the specified timeframe.

5. Scheduling, Rescheduling, and Cancellations

You may schedule, reschedule, or cancel your appointments through our Site. All scheduling, rescheduling, and cancellations must be made at least 24 hours in advance. Failure to do so may result in a cancellation fee.
 
• Emergency Cancellations: In case of emergencies, please contact us immediately to discuss your situation.
• No-shows: Clients who fail to show up for scheduled appointments without prior notice may be charged a no-show fee.

6. Text and Email Messages

By providing us with your email address or your cellular telephone number, you expressly consent to receiving communications using that contact information from Cox Property Repair. You acknowledge that your mobile provider’s standard rates for sending and receiving text messages will apply. If you wish to opt-out of receiving text or email messages, email us at office@coxpropertyrepair.com.

7. Warranty of Workmanship

We provide a 30-day warranty on our workmanship. If any issues arise related to the quality of our work within this period, please contact us, and we will address the problem at no additional cost. This warranty does not cover normal wear and tear, misuse, or modifications made by the client or third parties.

8. Prohibited Activities

Users are prohibited from:
 
• Violating any local, state, national, or international law or regulation.
• Engaging in any activity that is harmful, fraudulent, or deceptive.
• Using the Site to harass, abuse, or harm another person.
• Interfering with the proper functioning of the Site, including transmitting any viruses, malware, or harmful code.
• Attempting to gain unauthorized access to any portion of the Site, other user accounts, or any systems or networks connected to the Site.
• Impersonating another user or providing false information.
• Uploading malicious software or viruses.

9. Limitation of Liability

Cox Property Repair shall not be liable for any direct, indirect, incidental, special, or consequential damages resulting from the use or inability to use our services or for the cost of procurement of substitute services. Our total liability shall not exceed the amount paid by you for the services in question. Additionally, Cox Property Repair is not responsible for ensuring perfect color matching of surfaces or replacing broken ceiling tiles similar to those found in commercial offices.
 
Examples of handyman services related to color matching surfaces include, but are not limited to:
 
 • Touch-up painting on walls or trim where the exact paint color may not match the existing surface perfectly.
 • Patching and painting drywall repairs where the new paint may slightly differ from the original.
 • Staining or sealing wood surfaces where the new finish may vary from the existing color.
 • Repairing or replacing sections of flooring where the new material may not be an exact match to the existing floor.
 
Furthermore, Cox Property Repair is not liable for:
 
 • Pre-existing conditions: Any damage or issues that were present before the commencement of our services.
 • Consequential damages: Any indirect or consequential damages, including but not limited to loss of use, loss of profits, or loss of business.
 • Third-party products: Any defects or failures related to materials, products, or equipment provided by third-party manufacturers or suppliers.
 • Unauthorized alterations: Any damage or issues arising from modifications, repairs, or alterations made by the client or third parties without our prior written consent.
 • Weather-related damages: Any damage caused by natural events such as storms, floods, or other weather-related incidents.
 
By using our services, you acknowledge and agree to these limitations and understand that perfect color matching and other specific guarantees are not provided.

10. Dispute Resolution

Any disputes arising out of or related to these Terms or our services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in Topeka, Kansas, and the arbitrator’s decision shall be final and binding. These Terms shall be governed by the laws of the State of Kansas.
 
• Arbitration Fees: Each party shall be responsible for their own arbitration fees unless otherwise determined by the arbitrator.
 

11. Changes to Terms

We reserve the right to modify these Terms at any time. Any changes will be effective immediately upon posting the updated Terms on our Site. Your continued use of the Site after any such changes constitutes your acceptance of the new Terms. We will notify users of significant changes via email or a notice on the Site.
